Campaigners fighting controversial changes to services at Banbury’s Horton Hospital have suffered a legal blow.
Stratford District Council and neighbouring councils, launched a legal challenge to the way the public consultation into the changes was run by Oxfordshire Clinical Commissioning Group (OCCG).
Their objection centred on the OCCG’s decision to split the consultation into the changes into two.
The challenge went to a judicial review at the High Court, but on Friday Justice Mostyn concluded the argument was strong on rhetoric but short on hard data.
He believed there was no material, significant unfairness.
Keith Strangwood, chairman of Keep the Horton General, said: “We are naturally very disappointed with the result, we believe that the Judge was not sympathetic to our cause and we will be seeking further advice on our options.
“We are disappointed that the Judge thought it appropriate to release his judgement a day before everyone breaks for the festive season.”
